Also Present was James Hartney of 682 East Lake Road in Penn Yan, NY 14527
Steve Brigham called the meeting to order at 5:59 pm.
New Business
Area Variance PZ25-0005 for Steve O'Malley located at 682 East Lake Road in Penn Yan, NY submitted an application to build a retaining wall. Lisa O'Malley stated that it will resemble the retaining wall that was built at the neighboring property of Jim Hartney, who was present. They are asking for a 9 ft variance for the front setback (25' for the wall is actually 16') & a side setback variance of 7 ft (8' for the end of the retaining wall is actually 1' to the south).
Highway Superintendent, Steve Wheeler stated that the retaining wall should not crowd the right-of-way & DO NOT fill in the ditch. There was a discussion not to alter the flow of traffic & the contractor needs to complete a right-of-way permit.
Jeff Townley asked if there are any drainage issues of which there does not seem to be any concerns. Jeff made a motion to accept the area variance & Paul Danielson seconded the motion.
The area variance was unanimous approved.
The next meeting is scheduled for Thursday, August 14, 2025.
